Shawn Hogan is accused of Cookie Stuffing

This is pretty ugly and since I am banned from posting on DP, I will do it here.
Regardless of what happened and what the outcome of the trial might be, I am very sorry to hear about this.
I am not surprised to see ebay looking for someone to make an example of and choosing someone as high profile as Shawn.
Seriously, this is one of those moments where I really don´t care what happened and will happen as long as nobody truly gets hurt.
The lawyers will have their way with this. Shawn has done a lot to help many.
One thing I have noticed is that ebay is using a number like $5k.
If a guy like Shawn was to do cookie stuffing, the true amount would be in the ...
gazillions.
So ebay is lowering the number to discouraging others from trying it, or something else is not right about that lawsuit.

eBay are challenging him on what they can prove - which is probably just the tip of the iceberg.

My guess is that Shawn has pushed the TOS and the technology to the limits.

eBay had 2 choices:
1. Ban Shawn et al and wait for them to bring in the lawyers. In the meantime eBay would have to write the losses off which hurts their bottom line. From a Public Relations perspective that keeps eBay away from conflict but it doesn't send any sort of message to all the kiddie scripters.
2. Bring action against Shawn et al and send a clear message to the kiddie scripters and to their users that abuse won't be tolerated.

The losses aren't just the $5k they're claiming, or even the rest of the revenue they feel might have been unfairly earned. There's the cost of the investigation, the legal team in deciding if there is a case to bring and from here on in it's going to be phenomenal amounts of $$$ spent on lawyers, PR, technology changes... the list of people clipping the ticket will be substantial.

The problem now is that all efforts will be put into this case by ebay. Their approach is going to be to set an example. This is why this case seems to be important.
The amount of cookie stuffers out there is huge.

But because of Shawn´s popularity, they will focus on this case to send a message to everyone.

Added: Despite of what so many people have been writing prematurely, this is a civil suit and no criminal charges have been filed.
I may have been wrong reading too much into this.

The thread on DP is amazing btw. All those psychics who are either 100% sure that Shawn did or didn´t do it.

Tell them to all send me next weeks lotty numbers so I can determine based on which side wins me the most, what the truth really is.

All proceeds will be donated to the Shawn Hogan defence fund ;)

Apparently in America cookie stuffing can be illegal. Linda knows her stuff and see what she says here: http://forums.digitalpoint.com/showpost.php?p=9028291&postcount=243

Having read everything, I am sure my forums are stuffed full of cookies. Hasn`t even crossed my mind how easy it is to sign up at any forum and install those things there.

What Shawn should do is write a script for vb which helps forum owners detect cookies inserted into posts by forum members.

Its just a matter of grabbing every image posted and ensuring it is an image and that it is a realistic size.
